This Privacy Policy explains how Qwik-Law LLC / DBA Qwik-Code (“Qwik-Law LLC”, “Qwik-Code,” “we,” “us,” or “our”) collects, uses, protects, and handles information in connection with the Qwik-Code mobile application, website, and related services (collectively, the “Service”).
Qwik-Code is a legal-code and enforcement-reference application designed to provide convenient access to statutory, regulatory, and related legal-reference information. Qwik-Code is available to the general public, including law-enforcement officers, public-safety personnel, government employees, attorneys, businesses, and other users. The Service is intended for users 18 and older.
We designed Qwik-Code to minimize the collection and transmission of user information.
1. Information We Collect
1.1 Account Information
Qwik-Code requires users to create an account in order to access the Service. An account is required to authenticate your subscription entitlement and to provide account deletion. We collect:
- Name;
- Email address;
- Username;
- Password or authentication credentials;
- Account status;
- Subscription status; and
- Information necessary to maintain and secure your account.
We collect only information reasonably necessary to establish and maintain your Qwik-Code account.
1.2 Analytics and Diagnostic Information
To the extent the application includes analytics, crash-reporting, or diagnostic functionality, we may collect limited technical information such as device type and model, operating-system version, application version, language and region settings, crash and error reports, and aggregated information about which features of the application are used. Any such information is used only for application performance, security, troubleshooting, and enhancement. We do not use analytics or diagnostic information for advertising, and we do not use it to build a profile of your legal-reference searches. Where a third-party provider processes this information on our behalf, that provider is bound to use it only to provide services to us. We will update this section to identify any such provider if one is used.
1.3 Search History
Qwik-Code may maintain a history of searches performed within the application. Search history is stored locally on the user’s device and is not transmitted to or stored on Qwik-Code’s servers. Qwik-Code does not use your search history to create an investigative profile, law-enforcement profile, advertising profile, or behavioral profile. Users may delete search history through the features provided within the application.
1.4 Legal-Reference Searches
Qwik-Code is designed to allow users to search and reference legal codes and related information. Qwik-Code does not require users to enter names of individuals, driver or vehicle information, case or citation numbers, Social Security numbers, criminal-history information, investigative information, police reports, evidence, photographs, audio recordings, or other law-enforcement case information. Users should not enter sensitive personal or investigative information into Qwik-Code search fields.
1.5 Information We Do Not Collect Through the Application
Qwik-Code does not request or intentionally collect precise GPS or location information, camera data, microphone recordings, contacts, photos or photo-library contents, Bluetooth information, call logs, text messages, health information, or law-enforcement investigative records. Qwik-Code does not require access to these device features for its core functionality. Qwik-Code does not permit users to upload or submit content to the Service.
2. Information Stored on Your Device
Certain information may remain on your device to allow Qwik-Code to function efficiently, including search history; user notes, highlights, and bookmarks; application preferences; cached legal-reference content; application settings; and other locally stored application data. Information stored locally on your device is subject to the security of the device itself. We recommend that users protect their devices with a strong passcode, device-level biometric authentication, current operating-system updates, and other security measures appropriate to the device.
3. Cloud Storage
Qwik-Code does not use cloud storage to store users’ search history or legal-reference searches. Qwik-Code’s servers may process information necessary to operate user accounts, authenticate users, manage subscriptions, provide application updates, maintain security, process any analytics and diagnostic information described in Section 1.2, and provide other core Service functions. Search history and user-entered search information are not uploaded to Qwik-Code’s servers as part of the normal operation of the application.
4. Website and Cookies
QwikCode.com uses cookies strictly necessary to operate the site, including shopping-cart, checkout, session, and account-authentication cookies. The site also uses Google Analytics, a web-analytics service provided by Google LLC, to measure site traffic and understand how visitors use the site. Google Analytics uses cookies and similar identifiers to collect information such as the pages you visit, the date and time of your visit, your approximate location derived from your IP address, and your browser and device type. Google processes this information on our behalf under Google’s terms and privacy policy. We have configured Google Analytics so that it does not use this information for advertising personalization and does not collect data through Google Signals. We do not use Google Analytics data to identify individual visitors, and we do not combine it with account information. You may prevent Google Analytics from collecting information about your visits by installing Google’s browser opt-out add-on (available at https://tools.google.com/dlpage/gaoptout) or by disabling cookies in your browser settings, although disabling necessary cookies may prevent parts of the site from functioning. Other than Google Analytics, the site does not use third-party advertising or tracking cookies.
5. Legal-Reference Content
Qwik-Code provides access to legal and enforcement-reference information concerning jurisdictions currently supported by the Service. Legal information may change after it is incorporated into the application. Qwik-Code does not guarantee that every provision, statute, regulation, ordinance, summary, interpretation, penalty, or other legal-reference material is current, complete, or applicable to a particular situation. Users should independently verify important legal information against the applicable official governmental source before relying upon it for an enforcement, legal, regulatory, or other consequential decision.
6. Law-Enforcement Use
Qwik-Code may be used by law-enforcement officers and other public-safety personnel. Qwik-Code is not a records-management system, computer-aided dispatch system, evidence-management system, criminal-information database, investigative database, or official law-enforcement records system. Qwik-Code does not provide law-enforcement agencies with access to users’ search history and does not provide agency administrators with a dashboard or other mechanism to monitor individual users’ searches. Use of Qwik-Code does not create or establish any law-enforcement authority. Users remain responsible for complying with all applicable laws, regulations, agency policies, court orders, and professional requirements.
7. Subscriptions and Payments
Qwik-Code may offer paid subscription plans. Payment processing may be provided through third-party payment services, including Stripe, or through the applicable mobile application marketplace. Qwik-Code does not receive or store your complete payment-card number when payment processing is handled by a third-party payment provider. Payment providers collect and process payment and billing information according to their own privacy policies and terms. We may receive limited information from payment providers necessary to confirm a subscription, determine subscription status, process refunds, prevent fraud, provide customer support, and manage your Qwik-Code account.
8. Information We May Receive From Third Parties
We may receive limited information from service providers necessary to operate the Service. For example, payment providers may provide information confirming that a subscription is active, expired, canceled, or otherwise associated with an account. Third-party service providers are expected to process information according to their applicable agreements, privacy policies, and legal obligations.
9. How We Use Information
We may use account and service information to create and maintain your account; authenticate your identity; provide access to Qwik-Code; process and manage subscriptions; provide customer support; communicate important service information; detect unauthorized access or fraud; protect the security of the Service; troubleshoot technical issues; improve application performance; comply with legal obligations; and enforce our Terms of Service. We do not use your locally stored search history for advertising or behavioral profiling.
10. Information Sharing
We do not sell or share your personal information, as those terms are defined under applicable law. We may disclose limited information to service providers that help us operate Qwik-Code, such as payment processors, hosting providers, authentication providers, email providers, analytics or diagnostic providers, security providers, or other technology providers, each of which is bound to use that information only to provide services to us.
We may also disclose information when required by law; in response to valid legal process; to protect the rights, safety, or security of Qwik-Code, its users, or others; to investigate fraud, abuse, or security incidents; as part of a merger, acquisition, financing, sale, or other business transaction; or with your direction or consent.
11. No Sale of Search History
Qwik-Code does not sell, rent, license, or provide users’ search history to law-enforcement agencies, advertisers, data brokers, or other third parties. Because search history is maintained locally on the user’s device, Qwik-Code does not ordinarily possess that search history.
12. Do Not Track and Tracking Technologies
Qwik-Code does not respond to browser “Do Not Track” signals. Qwik-Code does not track users across third-party websites or online services for the purpose of targeted advertising. Except for the website analytics described in Section 4, Qwik-Code does not permit third parties to collect personal information about your online activities over time and across different websites or services through the Service.
13. Security
We encrypt information in transit between the application and our servers, and we encrypt stored account information. We also use administrative, technical, and organizational safeguards including authentication controls, access controls, security monitoring, secure software-development practices, logging of appropriate security events, and protection against unauthorized access. No electronic system can be guaranteed to be completely secure.
14. Account Deletion
You may request deletion of your Qwik-Code account. Qwik-Code provides an account-deletion mechanism within the application and an external account-deletion request mechanism through the Qwik-Code website at QwikCode.com. When an account is deleted, we will delete the personal information associated with the account, except information we are required by law to retain, or that we retain for a limited period for fraud prevention, security, or dispute resolution as described in Section 16. Information stored solely on your device, including locally stored search history, may need to be deleted by the user through the application’s deletion controls or by removing the application from the device.
15. Subscription Cancellation
Deleting your Qwik-Code account does not necessarily cancel a subscription purchased through Apple, Google, or another third-party marketplace. Users are responsible for canceling marketplace subscriptions through the applicable marketplace. Where Qwik-Code processes subscription payments directly, cancellation procedures are provided through the applicable Qwik-Code account or billing system, as described in the Terms of Service.
16. Data Retention
We retain account and transaction information only for as long as reasonably necessary to provide the Service, maintain security, comply with legal requirements, resolve disputes, enforce agreements, maintain financial records, or satisfy other legitimate business requirements. Locally stored search history remains on the user’s device until deleted by the user or removed through applicable application or device controls.
17. Children’s Privacy
Qwik-Code is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it. Parents or guardians who believe a child has provided personal information to Qwik-Code may contact us at the address in Section 20.
18. California Privacy Rights
Qwik-Code is committed to honoring the privacy of California residents. California residents may request to know what personal information we have collected about them, request correction of inaccurate personal information, request deletion of their personal information, and obtain information about the categories of personal information we collect and disclose. Qwik-Code does not sell or share personal information and will not discriminate against any user for exercising privacy rights. To submit a request, contact Contact@QwikCode.com or call (208) 229-0565. We may need to verify your identity before completing a request, and we will respond within 45 days.
19. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the application, website, email, or another reasonable method. The “Last Updated” date at the top of this Privacy Policy identifies the most recent revision.
